Agreement

These Terms of Use ("Terms") form an agreement between you and BITBILLION TECHNOLOGIES (OPC) PRIVATE LIMITED concerning your use of Peptimize. By downloading, accessing or using Peptimize, you agree to these Terms. If you do not agree, do not use Peptimize.

Eligibility

You must be at least 18 years old and legally capable of entering into these Terms. Peptimize is not intended for children.

Licence to use Peptimize

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use Peptimize for your own lawful, non-commercial record-keeping and educational purposes on devices you own or control.

What Peptimize does

Peptimize helps users manually record and review information such as doses, schedules, injection body sites, weight, symptoms, appetite, nutrition, inventory, reminders and notes. It may also provide educational links and summaries in a Research Library, based on publicly available regulatory and scientific sources.

Peptimize does not calculate dose, concentration, syringe units, injection volume, reconstitution or titration, and does not recommend a dose or schedule. You record only what has already been decided with a qualified healthcare professional.

Peptimize does not provide healthcare, telemedicine, diagnosis, treatment, prescribing, medication supply, laboratory services or emergency monitoring, and is not a medical device. See our Medical Disclaimer for details.

Your responsibility

You are solely responsible for decisions concerning your health, medication, dose, schedule, route, injection technique, storage, sourcing and treatment. Enter only information that reflects instructions provided or approved by a qualified healthcare professional. Do not start, stop, substitute or change a medication or dose based on Peptimize. You are responsible for the accuracy of the information you enter and for all decisions you make based on your own records.

Investigational, unapproved and compounded substances

Peptimize may allow manual tracking of substances that are investigational, unapproved, compounded, regionally restricted or described for research purposes. Inclusion in the app does not mean that a substance is approved, lawful, effective, safe, sterile, authentic, suitable for human use or recommended by Peptimize.

Peptimize does not encourage the purchase, possession, preparation, administration or self-experimentation of an investigational or unapproved substance. You are responsible for complying with local laws and obtaining qualified medical advice.

Research Library

Research Library information is provided for general educational context. Sources may include regulatory documents, prescribing information, scientific papers, trial registries or third-party websites. Information can become outdated, incomplete or inaccurate, and approval status can vary by country or change over time. Verify current information through official sources and a qualified professional. See our Medical Disclaimer for the full Research and Investigational Content Notice.

Reminders & notifications

Reminders are organisational aids only. Notifications may be delayed, suppressed or missed because of device settings, battery state, operating-system behaviour, time-zone changes or technical faults. You must not rely on Peptimize as the only method for remembering a medication or responding to a health concern.

Peptimize Pro

Peptimize is free to use. Version 2.0 and later also offers an optional paid subscription, Peptimize Pro, which unlocks four analysis features: Appetite Cycle, Weekly Analysis, Pattern Insights and Advanced Trends.

A subscription is never required to record, review, export or delete your own information. Dose, weight, symptom and appetite logging, reminders, supplements, body measurements, inventory and run-out prediction, Apple Health and Health Connect import, Quick Log and PDF reports are part of the free app.

Peptimize Pro presents information you have already recorded in a different form. It does not add medical advice, dose recommendations, diagnosis or clinical interpretation, and everything these Terms and the Medical Disclaimer say about what Peptimize is not applies equally to Pro.

Billing, renewal and cancellation

Peptimize Pro is an auto-renewing subscription, offered as a monthly plan and an annual plan. The length of each subscription period, what it includes and the price in your local currency are shown in the app before you buy, on the subscription screen.

Purchases are processed by Apple or Google, not by us. We do not see, receive or store your card number, billing address or payment method, and we cannot charge you directly.

• Payment is charged to your Apple Account or your Google Account when you confirm the purchase.
• The subscription renews automatically for a further period of the same length, at the price shown, unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for the renewal within the 24 hours before the current period ends.
• You can manage the subscription and turn auto-renewal off at any time after purchase, in your Apple Account settings or in your Google Play subscriptions. Peptimize links to that screen from Profile › Subscription.
• Turning auto-renewal off stops the next charge. It does not shorten the period you have already paid for - Pro stays unlocked until that period ends.
• Where a free trial or introductory offer is available, its terms are shown at the point of purchase. Any unused part of a free trial is forfeited when you buy a subscription.

Refunds are handled by the store you bought from, under that store's own policy. We cannot issue, reverse or reduce a charge ourselves. Apple customers request a refund at reportaproblem.apple.com; Google Play customers use Google Play's refund process. Write to us at support@peptimize.xyz if something has gone wrong and we will help where we are able to.

Prices may change. Where a price increase would affect a subscription that is already running, Apple and Google notify you and - where their rules or your local consumer law require it - ask you to agree before the increase takes effect. If you do not agree, the subscription ends at the end of the current period.

Deleting the app, or erasing your data inside Peptimize, does not cancel a subscription: the subscription is held by the store, not by us. Cancel it in the store account you bought it with.

Nothing in this section limits mandatory rights you have under consumer law, including any statutory right to cancel a distance contract.

Acceptable use

You must not:

• use Peptimize for unlawful, harmful, fraudulent or deceptive purposes;
• use the app to prescribe, direct or manage another person's medical treatment without lawful authority;
• misrepresent Peptimize as providing medical advice or regulatory approval;
• copy, modify, reverse engineer, decompile, bypass security, scrape or commercially exploit Peptimize except where law expressly permits;
• interfere with the app, website, infrastructure or other users;
• upload or transmit malware, abusive content or unlawful material through support channels; or
• use Peptimize in a way that infringes intellectual-property, privacy or other rights.

Intellectual property

Peptimize, its design, software, branding, text, graphics and original content are owned by or licensed to BITBILLION TECHNOLOGIES (OPC) PRIVATE LIMITED and are protected by applicable intellectual-property laws. Third-party names, scientific works, regulatory materials and trademarks belong to their respective owners.

Third-party services and links

Peptimize may link to third-party resources or rely on platform services provided by Apple, Google or other providers. We do not control and are not responsible for third-party content, terms, availability, accuracy, products, services or privacy practices.

App Store and Google Play terms

Peptimize is distributed through the Apple App Store and Google Play. The following terms are required by those platforms and apply in addition to the rest of these Terms. Where this section conflicts with another section, this section governs for the copy of Peptimize you obtained from that store.

1. Acknowledgement. These Terms are concluded between you and BITBILLION TECHNOLOGIES (OPC) PRIVATE LIMITED only, and not with Apple or Google. We alone, and not Apple or Google, are responsible for Peptimize and its content. These Terms do not conflict with the Apple Media Services Terms and Conditions or the Google Play Terms of Service.
2. Scope of licence. The licence granted to you above is a non-transferable licence to use Peptimize on any Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions - except that Peptimize may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
3. Maintenance and support. We are solely responsible for providing any maintenance and support for Peptimize, as specified in these Terms or as required by law. Apple and Google have no obligation to furnish any maintenance or support services for Peptimize.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Peptimize fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Peptimize, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
5. Product claims. We, and not Apple or Google, are responsible for addressing any claim by you or a third party relating to Peptimize or your possession and use of it. This includes product liability claims, any claim that Peptimize fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation - including any such claim in connection with Peptimize's use of HealthKit or Health Connect.
6. Intellectual property rights. If a third party claims that Peptimize or your possession and use of Peptimize infringes that party's intellectual property rights, we, and not Apple or Google, are solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms. You must comply with any applicable third-party terms of agreement when using Peptimize.
10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, on your acceptance of these Terms, Apple will have the right - and is deemed to have accepted the right - to enforce these Terms against you as a third-party beneficiary. Google holds the same right in respect of copies of Peptimize obtained through Google Play.

Changes, availability and termination

We may update, modify, suspend or discontinue some or all of Peptimize, including features, supported substances, research content or availability, where reasonably necessary. We do not guarantee uninterrupted or error-free operation. We may terminate your licence if you materially breach these Terms.

Warranty disclaimer

To the maximum extent permitted by law, Peptimize and BITBILLION TECHNOLOGIES (OPC) PRIVATE LIMITED disclaim warranties of merchantability, fitness for a particular purpose, accuracy, uptime, or non-infringement. The service is provided on an "as is" and "as available" basis. We do not warrant that entries, reminders, research content, or displayed timelines are complete, current or error-free.

Limitation of liability

To the maximum extent permitted by law, we are not liable for medical decisions, adverse events, missed or incorrect doses, delayed treatment, data loss, missed reminders, or any indirect, incidental, special, consequential, exemplary or punitive damages arising from use of the app.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights. Where liability may lawfully be limited, our aggregate liability relating to Peptimize will not exceed the greater of the amount you paid for the app in the preceding 12 months or INR 5,000.

Indemnity

To the extent permitted by law, you agree to indemnify us against third-party claims, losses and reasonable costs arising from your unlawful misuse of Peptimize, violation of these Terms or infringement of another person's rights. This does not apply where prohibited by consumer law.

Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory consumer rights and jurisdictional protections, the courts located in Bengaluru, Karnataka will have exclusive jurisdiction.

Changes to the Terms

We may update these Terms when the app, law or business changes. The updated Terms will be posted with a new effective date. Continued use after the updated Terms become effective constitutes acceptance where permitted by law.

General

If any provision is held unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms, the Privacy Policy and Medical Disclaimer constitute the agreement concerning your use of Peptimize.
